Federal Overreach? A Coalition Pushes Gun Control in the Ninth Circuit

The Second Amendment Under Siege

As America continues to wrestle with issues surrounding public safety and constitutional rights, what we’re witnessing out of the Ninth Circuit may have far-reaching effects for every law-abiding gun owner in the nation. In a move that has struck a nerve with Second Amendment advocates, Michigan Attorney General Dana Nessel has spearheaded a coalition of 17 Democratic-led states supporting Hawaii’s ultra-restrictive gun control laws in federal court. This coalition’s actions have become a focal point in the debate over whether states should have the authority to impose sweeping firearm limitations — often going beyond what the U.S. Constitution allows.

What’s at Stake in the Hawaii Gun Laws Case?

The case in question revolves around Hawaii’s restrictive carry laws, which severely limit where and how individuals can carry their firearms in public. Essentially, these laws ban the carrying of firearms across much of public life — including beaches, banks, and parks. Despite the Supreme Court’s landmark decision in New York State Rifle & Pistol Association v. Bruen, which clearly reaffirmed the individual right to carry a firearm outside the home for self-defense, states like Hawaii are pushing back with renewed vigor.

Attorney General Nessel, along with her counterparts in states like California, New York, and Illinois, filed an amicus brief arguing that these restrictions are necessary for public safety and should be upheld by the Ninth Circuit Court of Appeals.

But at what cost?

Public safety should never come at the expense of constitutional rights. We’ve seen time and time again the slippery slope that begins when bureaucrats and politicians are allowed to decide — arbitrarily — who can exercise their fundamental liberties. The result is not only the erosion of Second Amendment protections but also the empowerment of criminals who know the average citizen is less likely to be armed and prepared.

The Irony of Gun Control in Violent Cities

It’s no coincidence that many of the states supporting Hawaii’s gun control policies have some of the highest violent crime rates despite their increasingly strict gun laws:

  • Chicago, Illinois has seen persistent gun violence, even with some of the toughest gun laws in the country.
  • Los Angeles, California continues to face gang-related shootings and homicides, despite its complex web of firearm regulations.
  • Detroit, Michigan, Nessel’s backyard, struggles with high crime, and yet the push is for more laws that only serve to disarm law-abiding citizens.

Limiting ownership to only non-lethal firearms? Annual psychological evaluations to own a handgun?
